These Terms of Service govern access to and use of the OrcaCAD website, account system, Community, beta features, model packages, and related services operated by Curvature Flow Co., Limited. These terms should be read together with the User Manual, Privacy Policy, and AI-Generated Design Notice.
By creating an account, logging in, submitting a form, browsing Community, ordering a model package, or using OrcaCAD, the user agrees to these Terms of Service. If a user does not agree, the user should not use Orca.
Users are responsible for providing accurate account information, maintaining credential security, and all activity under their accounts. OrcaCAD may suspend or restrict accounts that appear inaccurate, compromised, abusive, unlawful, or harmful to the platform.
OrcaCAD features may be experimental, incomplete, limited, unavailable, or changed without notice during beta. OrcaCAD may approve, reject, pause, or revoke beta access at its discretion to protect product quality, safety, legal compliance, and platform security.
Community access, model preview, parameter adjustment, model ordering, and DIY package download are provided for approved users under the current beta rules. Each user may be limited to one free model claim during beta. OrcaCAD may change limits, pricing, availability, model metadata, licenses, and download rules as the product evolves.
Models and packages may be generated or modified with AI. Users must read and accept the AI-Generated Design Notice before downloading model packages. OrcaCAD does not guarantee that any design is safe, manufacturable, legally compliant, fit for a particular purpose, or free from defects.
Users are responsible for complying with all applicable laws, regulations, standards, certifications, import and export controls, consumer protection rules, product safety rules, workplace safety rules, and intellectual property laws in the user's country or region, the manufacturing location, the shipping destination, and any other applicable jurisdiction. OrcaCAD does not provide legal, engineering, manufacturing, compliance, or certification advice, and users must independently confirm whether a design, download, fabrication, distribution, sale, import, export, or use is lawful before proceeding.
Users must not use OrcaCAD for unlawful, harmful, deceptive, infringing, unsafe, abusive, privacy-violating, export-control-violating, or security-violating activity. OrcaCAD must not be used to create, request, modify, download, manufacture, sell, share, import, export, or distribute illegal designs, dangerous-goods designs, weapons, weapon parts, explosive devices, hazardous chemicals, unsafe pressure vessels, harmful tools, or designs intended to injure people, bypass safety controls, evade certification, or evade legal regulation.
Users retain ownership of content they submit, unless otherwise agreed. By submitting, uploading, commenting, or publishing content on OrcaCAD, users confirm they have the necessary rights and grant OrcaCAD a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, process, adapt for technical compatibility, translate, distribute through the platform, moderate, and use the content to operate, secure, support, and improve Orca.
Designs, datasets, model files, drawings, renderings, metadata, documentation, software, interface elements, trademarks, and related content published by OrcaCAD Official are owned by OrcaCAD or Curvature Flow Co., Limited unless otherwise stated. Users may only use such content under the license or permission displayed for the specific item.
Each dataset, model, drawing, rendering, or package may be subject to its own license, such as CC BY-NC or another listed license. Users must comply with the applicable license, including attribution, non-commercial restrictions, share-alike requirements, no-derivatives rules, or other limitations. If a license conflicts with these terms, the stricter rule applies unless OrcaCAD states otherwise in writing.
If any user or rights holder believes content on OrcaCAD infringes copyright, trademark, design rights, patent rights, trade secrets, or other rights, the concern should be reported to [email protected] with enough information to identify the content and rights involved. OrcaCAD may remove or restrict content while reviewing rights issues.
OrcaCAD processes personal information according to the Privacy Policy. Use of OrcaCAD may involve account records, beta application records, analytics records, Community activity, model claims, comments, and support messages.
To the fullest extent permitted by applicable law, OrcaCAD is provided on an as-is and as-available basis. OrcaCAD does not warrant uninterrupted availability, error-free operation, secure access, accurate output, design safety, manufacturing quality, non-infringement, merchantability, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, OrcaCAD, the OrcaCAD team, and Curvature Flow Co., Limited are not liable for personal injury, property damage, product defects, failed manufacturing, assembly accidents, recall costs, data loss, business loss, indirect loss, consequential loss, lost profits, or other damages arising from use of OrcaCAD, Community models, or downloaded packages.
Users agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from the user's unlawful use, unsafe fabrication, user content, rights infringement, breach of these terms, or violation of applicable laws, to the extent permitted by law.
OrcaCAD may modify features, update these terms, suspend services, remove content, or terminate access where necessary for security, legal compliance, abuse prevention, product development, or operational reasons. Continued use after changes means the user accepts the updated terms.
Model packages and credits are digital goods delivered immediately. Once a design package has been downloaded — the moment the user clicks download and the package is generated — that order, the credits spent, and the related payment are final and non-refundable, and downloaded files cannot be returned. In exceptional cases, such as a confirmed technical fault that prevented delivery, a duplicate charge, or a clear billing error, the user may email [email protected] to request a review, and OrcaCAD may at its sole discretion grant a partial or full refund or restore credits. Except where a refund is required by mandatory applicable law, all sales are final.
These Terms, and any dispute or claim arising out of or relating to them, OrcaCAD, Community, model packages, or downloaded files, are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-law rules, except where mandatory consumer-protection or other laws of the user's place of residence apply. The parties will first try to resolve any dispute informally by contacting [email protected]. If a dispute cannot be resolved within thirty days, it will be submitted to the courts of competent jurisdiction in Hong Kong, unless mandatory local law gives the user the right to bring proceedings in another forum. Nothing in these Terms removes any non-waivable statutory rights a user has under the laws of their country or region.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision will be applied to the maximum extent permitted by law. These Terms, together with the User Manual, Privacy Policy, and AI-Generated Design Notice, form the entire agreement between the user and OrcaCAD regarding the services and replace any prior understanding on the same subject.
